How vacation days are calculated in Spain
Article 38.1 of the Workers' Statute (Estatuto de los Trabajadores) sets a minimum of 30 calendar days of paid vacation a year, which cannot be swapped for money while the contract lasts. Your collective agreement or contract may give you more, and many agreements count them in working days instead of calendar days.
If you weren't at the company for the whole year, because you started or left mid-year, the general rule is a share proportional to your time there that year: annual vacation × days at the company ÷ days in the year. Working part-time does not reduce the number of days: you get the same as a full-time colleague.
- 1
Enter your annual vacation
30 calendar days is the legal minimum. Change it if your agreement gives more or counts working days.
- 2
Add your dates if you didn't work the whole year
Your start date if you joined this year, and your end date if your contract ends before 31 December.
- 3
Subtract what you've already taken
You'll see the days you have earned and the days you have left.
Example: you start on 1 July
From 1 July to 31 December 2026 there are 184 days. With 30 calendar days a year: 30 × 184 ÷ 365 = 15.1 calendar days of vacation that year. If your agreement gives 22 working days: 22 × 184 ÷ 365 = 11.1 working days.
Is the result rounded?
The Workers' Statute doesn't say how to round the pro-rata share. Your collective agreement sets it, or you agree it with the company. That's why the calculator shows the result to one decimal place.

If you manage a team, Ficha.Work keeps track of everyone's vacation: staff request days from their phone, you approve or reject them, and each person sees their balance of available, used and pending days.

Vacation days FAQ
How many vacation days do I get a year in Spain?+
At least 30 calendar days a year (art. 38.1 of the Workers' Statute). Your collective agreement or contract can improve on that. Many agreements count them in working days; check yours to see exactly how many you get.
How many vacation days do I get if I start mid-year?+
The general rule is a share proportional to your time at the company that year: annual vacation × days at the company ÷ days in the year. For example, if you start on 1 July with 30 calendar days a year, you get about 15 days that year. Work it out above with your start date.
Do part-time workers get fewer vacation days?+
No. Part-time workers have the same rights as full-time workers (art. 12.4.d of the Workers' Statute), including the same number of vacation days. What you are paid during your vacation is your part-time salary.
What happens to untaken vacation when my contract ends?+
While the contract lasts, vacation cannot be swapped for money (art. 38.1 of the Workers' Statute). When the employment relationship ends, days earned and not taken are compensated in money (art. 7.2 of Directive 2003/88/EC): they are paid in your final settlement (finiquito). Enter your contract end date in the calculator to see how many.
What if I'm on sick leave when my vacation is due?+
If temporary incapacity (sick leave) stops you taking your vacation on the planned dates, you can take it when the leave ends, as long as no more than 18 months have passed since the end of the year in which it was earned (art. 38.3 of the Workers' Statute). If it coincides with leave for pregnancy, childbirth or breastfeeding, or with birth leave, you can also take it later even if the year has ended.
Does sick leave earn vacation? Which days don't count?+
Sick leave (incapacidad temporal) does earn vacation. Some periods when the contract is suspended may not, depending on the type of suspension and your collective agreement. If that's your case, check your agreement or ask your advisor (asesoría), and subtract those days in the calculator.
Who decides when I take my vacation?+
The dates are set by agreement between the company and the worker, following what the collective agreement says about annual vacation planning (art. 38.2 of the Workers' Statute). Each company sets its vacation calendar, and you must know your dates at least two months before your vacation starts (art. 38.3).
