Is a paper workday record valid?
Yes, for now. Art. 34.9 of the Workers' Statute, added by Royal Decree-law 8/2019, requires companies to keep a daily workday record with the specific start and end time of each employee, but it does not impose a format. The record is organised and documented by collective agreement, company agreement or, failing that, an employer decision after consulting the workers' legal representatives.
What it does require, whatever the medium: keeping the records for four years and making them available to employees, their legal representatives and the Labour and Social Security Inspectorate.
What about mandatory digital recording?
The Ministry of Labour has put out for public consultation a draft royal decree that would develop the workday record and require, among other things, the use of digital means. As of the date of this page (October 2026) it has not been published in the BOE, so it is not in force. If it is approved, we will update this page.
